Terms and conditions of sale
1. Seller
The products offered on kody-piercing.com are sold by SMPOTW OÜ, a company incorporated under Estonian law and registered under number 16633233, whose registered office is at Narva mnt 5, 10117 Tallinn, Estonia (hereinafter “Kody Piercing”). Contact: info@kody-piercing.com.
2. Scope
These general terms and conditions of sale (T&Cs) apply to any order placed on the website kody-piercing.com by a consumer customer (hereinafter “the Customer”). Placing an order implies acceptance of the T&Cs in force on the date of the order.
3. Products
The products are piercing jewellery and accessories described on their product page (material, dimensions, colour). The photographs are as accurate as possible but may differ slightly from the product. Offers are valid while stocks last.
4. Prices
Prices are shown in euros, including all taxes and excluding delivery charges. The applicable delivery charges are shown before the order is confirmed and are detailed on the Delivery & Returns page. Kody Piercing may change its prices at any time; the price invoiced is the one displayed when the order is confirmed.
5. Orders
The Customer selects their products, checks the contents of their basket, enters their details and chooses their delivery method, then confirms their order with an obligation to pay. A confirmation email summarising the order is sent to them. Kody Piercing reserves the right to cancel an order in the event of a previous payment dispute or if the product is unavailable; the Customer is then refunded in full.
6. Payment
Payment is made online at the time of ordering, using the methods offered at checkout. Transactions are secured by our payment provider; Kody Piercing never has access to the Customer’s bank details.
7. Delivery
Orders are dispatched within 1 to 2 working days to the address provided by the Customer. The areas served, rates and estimated delivery times are set out on the Delivery & Returns page. If a parcel is damaged or incomplete, the Customer records reservations with the carrier and contacts Kody Piercing as soon as possible. Risk passes to the Customer when the parcel is handed over to them.
8. Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Code de la consommation, the Customer has 14 days from receipt of their order to exercise their right of withdrawal, without having to give any reason, by writing to info@kody-piercing.com. The product must be returned new, unworn and in its original packaging no later than 14 days after the Customer has communicated their decision. Return costs are borne by the Customer.
Hygiene exception: in accordance with Article L221-28 5° of the French Code de la consommation, the right of withdrawal cannot be exercised for goods unsealed by the Customer after delivery which cannot be returned for reasons of hygiene or health protection. Piercing jewellery whose packaging has been opened or which has been worn therefore cannot be taken back.
All sums paid, including the initial delivery charges (at the standard rate), are refunded within 14 days of the decision to withdraw; the refund may be withheld until the returned product has been received. It is made using the same means of payment as that used for the order.
9. Legal guarantees
The products are covered by the legal guarantee of conformity (Articles L217-3 et seq. of the French Code de la consommation) for two years from delivery, and by the guarantee against hidden defects (Articles 1641 et seq. of the French Code civil). In the event of a defect, the Customer contacts Kody Piercing at info@kody-piercing.com, with supporting photos; the product is repaired, replaced or refunded in accordance with the law, in which case the return costs are borne by Kody Piercing.
10. Complaints and mediation
Any complaint may be sent to customer service at info@kody-piercing.com. If no amicable solution is reached, the consumer Customer may refer the matter to a consumer mediator free of charge.
11. Personal data
The data collected when an order is placed is necessary for its processing. Its use and the Customer’s rights are described in the Privacy Policy.
12. Governing law
These T&Cs are governed by French law, without prejudice to the mandatory protective provisions of the country of habitual residence of the consumer Customer. In the event of a dispute, the competent courts are those designated by law.
